1. About These Terms
These Terms and Conditions govern your use of The Margin Collective website at www.margin-collective.com and your subscription to our monthly print club service. By subscribing or using our website, you agree to these terms in full. If you do not agree, please do not use our services.
The Margin Collective is operated by a sole proprietor based in Pretoria, Gauteng, South Africa.
2. The Subscription Service
The Margin Collective is a monthly subscription print club. Each month, active subscribers receive a curated parcel delivered by courier to their registered delivery address. The parcel typically contains:
- One original signed print on quality paper
- A handwritten letter
- A creative prompt and a blank sheet of quality paper
- A selection of collage paper, bookmarks, tags, and other small creative items
The exact contents of each parcel may vary month to month at our discretion. We reserve the right to substitute items of equal or greater value where necessary.
3. Pricing and Billing
3.1 The current subscription price is R289 per month, inclusive of courier delivery within South Africa.
3.2 Payment is billed monthly on or around the date of your original subscription. Payments are processed securely through Paystack. By subscribing, you authorise us to charge your payment method on a recurring monthly basis until you cancel.
3.3 We reserve the right to change the subscription price. If we increase the price, we will notify you by email at least 30 days in advance. You may cancel your subscription before the new price takes effect if you do not wish to continue at the new rate.
3.4 All prices are listed in South African Rand (ZAR). We do not currently offer subscriptions in other currencies.
4. Cancellation Policy
4.1 You may cancel your subscription at any time by logging into your account and navigating to "My Subscription," or by emailing us at hello@themargincollective.co.za.
4.2 Cancelling your subscription stops the next monthly billing cycle. Any parcel that has already been dispatched at the time of cancellation will still be delivered โ we are unable to recall parcels once they have been collected by the courier.
4.3 There are no cancellation fees. We do not provide partial refunds for the current billing month.
4.4 After cancellation, your member account remains accessible. You may re-subscribe at any time.
5. Delivery
5.1 We deliver anywhere within South Africa by courier. We do not use the South African Post Office. We do not currently offer international delivery.
5.2 Parcels are typically dispatched between the 10th and 15th of each month. Courier delivery takes approximately 1 to 3 business days after dispatch, depending on your location.
5.3 It is your responsibility to ensure your delivery address in your account is accurate and up to date before each dispatch date. We cannot be held responsible for non-delivery due to an incorrect or outdated address provided by you.
5.4 If a parcel is returned to us due to an incorrect address, we will contact you and arrange redelivery. Additional courier costs for redelivery may be charged to you.
5.5 If your parcel is lost or damaged in transit, please contact us within 14 days of the expected delivery date at hello@themargincollective.co.za. We will work with the courier to resolve the issue and replace the parcel where possible.
6. Refund Policy
6.1 Due to the handmade, personalised, and time-sensitive nature of each monthly parcel, we do not offer refunds once a parcel has been dispatched.
6.2 If your parcel arrives damaged, or if items are missing, please contact us within 7 days of receiving your parcel with a description and photos of the issue. We will assess each case individually and offer a replacement or store credit at our discretion.
6.3 We do not offer refunds for change of mind after a parcel has been dispatched.
6.4 If you believe you have been incorrectly charged, please contact us within 30 days of the charge at hello@themargincollective.co.za and we will investigate promptly.
7. Intellectual Property
7.1 All artwork, illustrations, designs, written content, and creative work included in each monthly parcel or published on our website are the original work of The Margin Collective and are protected by South African copyright law.
7.2 By subscribing, you receive a personal, non-commercial licence to enjoy, display, and use the prints and items in your parcel for personal purposes only.
7.3 You may not reproduce, resell, distribute, or use any artwork or content from your parcel for commercial purposes without our express written permission.
7.4 Sharing photos of your parcel contents on social media is warmly encouraged โ we only ask that you credit @themargincollective where possible.
8. Your Account
8.1 To subscribe, you must create a member account on our website. You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.
8.2 You must ensure that all information in your account โ including your name, email address, phone number, and delivery address โ is accurate and kept up to date.
8.3 You must be at least 18 years of age to subscribe.
8.4 We reserve the right to suspend or terminate your account if you breach these Terms or engage in any fraudulent, abusive, or harmful behaviour.
9. Website Use
9.1 You may use our website for lawful purposes only. You may not use it in any way that is unlawful, harmful, or that could damage, disable, or impair the website.
9.2 We make every effort to keep the website accurate and available, but we do not guarantee that the website will be error-free or uninterrupted. We are not liable for any loss arising from website downtime or errors.
9.3 We reserve the right to modify or discontinue the website or any part of our service at any time with reasonable notice.
10. Limitation of Liability
10.1 To the fullest extent permitted by South African law, The Margin Collective will not be liable for any indirect, incidental, or consequential losses arising from your use of our service or website.
10.2 Our total liability to you in connection with any claim arising from your subscription shall not exceed the amount you paid us in the three months immediately preceding the claim.
10.3 Nothing in these Terms limits our liability for death, personal injury caused by our negligence, or any other liability that cannot be excluded by law.
11. Privacy
We take your privacy seriously. Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms and is available at www.margin-collective.com/privacy-policy. By subscribing, you agree to our Privacy Policy.
12. Consumer Protection
These Terms do not affect your rights under the South African Consumer Protection Act 68 of 2008 or any other applicable South African consumer protection legislation.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If we make significant changes, we will notify you by email. Your continued use of our service after changes are published constitutes your acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your subscription will be subject to the jurisdiction of the South African courts.
